                            REGULAR COUNCIL MEETING


        A Regular Meeting of the Council  of the City of Vancouver was held
   on  Thursday, January 11,  1996, at 2:12  p.m. in Committee  Room No. 1,
   Third Floor, City Hall, following the Standing Committee on Planning and
   Environment meeting, to consider the recommendations of the Committee.

                               January 11, 1996


        A  meeting of  the Standing  Committee of  Council on  Planning and
   Environment was held  on Thursday, January  11, 1996,  at 2:00 p.m.,  in
   Committee Room No. 1, Third Floor, City Hall.

   1.   Significant Rezoning Applications                      File: 5302-1

        The  Committee  had  before  it  a  list  of  significant  rezoning
   applications prepared by the Planning Department (on file).  


   Clause No. 1 cont'd


        Mr. Tom  Phipps, Planner,  reviewed a  rezoning  application by  J.
   Moodie/G. Eng to rezone 7400 Oak Street (Oakherst) from RS-1 to 
   CD-1.   The proposal would  develop 64 market  units in  two four-storey
   apartment  structures adjacent to Oak Street and 60 2.5 storey townhouse
   units.  Parklane  Hospital would  be restored to  provide 6  residential
   units.   Mr. Phipps noted this  is the first application  which has been
   received  under  the  Oakridge  plan  and  generally  falls  within  its
   guidelines.  Issues  were reviewed  including those related  to the  "A"
   class heritage building on the site and green/open space.

        Mr. Phipps also reviewed an application by Brian Sim to rezone 2750
   East  18th Avenue from RS-1 to CD-1  to develop a residential school for
   children  with  behavioural  problems.     Issues  include  play  space,
   institutional appearance and tree retention.

        The following  motion by  Councillor Bellamy  was put  and CARRIED.
   Therefore, the Committee

   RECOMMENDED

        THAT  the  Planning  Department  presentation  on  significant
        rezoning applications be received for information.




   2.   1525 Yew Street - Rossini's Restaurant                 File: 2612-7

        The Committee had before it an Administrative Report dated December
   5, 1995 (on  file), in which  the Director of  Permits and Licenses,  in
   consultation with the Directors of Environmental Health and Land Use and
   Development,  recommended  Council   continue  withholding   enforcement
   against Rossini's  Restaurant holding  jazz sessions  with a maximum  of
   four  musicians from  3:30 to  6:30 p.m.  on Saturdays  at this  Class 1
   Restaurant.    Council  had  previously  instructed  staff  to  withhold
   enforcement  for a period of one year.   The business has been monitored
   over the past  two summers, and staff have  received only one complaint,
   that the rear door had been left open.  The General Manager of Community
   Services  submitted  the question  of  whether to  continue  to withhold
   enforcement for Council's consideration.

        Mr.  Paul  Teichroeb,  Deputy  City   License  Inspector,  recalled
   Council's previous action and  indicated Rossini's has generally adhered
   to the  condition set at that time.  Staff  see no problem with allowing
   the extension to continue.  Queried whether this constitutes a precedent
   for other requests, Mr. Teichroeb noted any premises wishing to obtain a
   similar exemption would have to appear before City Council beforehand.

        Mr. Arni  May, Rossini's Restaurant,  explained the  back door  has
   been  left open occasionally,  usually in mid-afternoon  because of warm
   conditions.  However, a  new air conditioning system has  been installed
   to  prevent  the  Restaurant from  becoming  too  warm.   Rossini's  has
   responded immediately to any request to have the door closed.

        The  Committee  was  not averse  to  continuing  the  exemption for
   Rossini's Restaurant, but felt it should again specify a one year period
   of exemption  from enforcement rather than leave it open ended, in order
   to  better  protect  the interests  of  the  neighbours.   To  this end,
   Committee members requested Mr. May to  make every effort to ensure that
   the  back door  remains closed  during performances.   Concern  was also
   expressed about the possibility of creating a precedent.

        The  following motion  by Councillor Bellamy  was put  and CARRIED.
   Therefore, the Committee

   RECOMMENDED

        THAT Council  instruct staff  to withhold enforcement  for one
        year against  Rossini's Restaurant holding jazz  sessions by a
        maximum of four musicians from 3:30 to 6:30 p.m. on Saturdays,
        subject to compliance by Rossini's.
