                            SPECIAL COUNCIL MEETING


        A Special Meeting of the Council of the City of Vancouver  was held
   on Tuesday, September  26, 1995  at 2:05 p.m.,  in the Council  Chamber,
   third floor,  Vancouver City Hall, for  the purpose of holding  a Public
   Hearing to consider proposed amendments to the Heritage By-law.

             PRESENT:  Mayor Owen
                       Councillors Bellamy, Chiavario, Clarke, Hemer,
                                 Kennedy, Kwan, Puil and Sullivan

             ABSENT:   Councillor Ip    (Sick Leave)
                       Councillor Price (Sick Leave)

   COMMITTEE OF THE WHOLE

   MOVED by Cllr. Bellamy,
   SECONDED by Cllr. Hemer,
        THAT this Council resolve itself into Committee of the Whole, Mayor
   Owen  in the Chair, to consider proposed  amendments to the Heritage By-
   law.

   1.   2836-2838 Birch Street (1299 West 13th Avenue)
        (Lots 19 and 20 North Half, Block 413
        District Lot 526, Plan 1276)                  

        An  application by  397453  BC  Ltd./Neale  Staniszkis  Doll  Adams
   Architects was considered as follows:

        The proposed amendment to the Heritage By-law would:

        -    designate the existing  building listed in the  "B" evaluation
             category  on the Vancouver  Heritage Register, and  located on
             the  northerly  half of  the  site  as  a  protected  heritage
             property;

        -    ensure  the  protection  of  the  building from  inappropriate
             alterations and demolition in the future; and

        -    be  in exchange  for approval  of a  relaxations to  the floor
             space ratio from  1.72 FSR to 2.04  FSR, the front yard,  east
             and  west yards, rear  yard setbacks, horizontal  and vertical
             angles of daylight for the site which the Director of Land Use
             and Development is able and prepared to support.

        The  Director of Use  and Development recommended  approval of this
   application.

   Staff Comments

        Mr. Robert  Lemon, Senior Heritage  Planner, advised staff  have no
   additional information other than exists  in the Council report,  except
   to note this is a creative example of heritage preservation.


   Summary of Correspondence

        There was no correspondence received on this application.


   Speakers

        The Mayor called  for speakers for and against  the application and
   none were present.


   MOVED by Cllr. Kennedy,
        THAT an amendment be brought forward  to Schedule A of the Heritage
   By-law  to designate  the existing  building at  2836-2838 Birch  Street
   protected heritage property.

        THAT the Committee of the Whole rise and report.

   MOVED by Cllr. Bellamy,
   SECONDED by Cllr. Puil,
        THAT the  report of the Committee of the  Whole be adopted, and the
   Director of  Legal Services be  instructed to prepare and  bring forward
   the necessary by-law amendments.
