Neighbourhood Pub - Fountainhead Pub Ltd.

CONSIDERATION

A. THAT Council endorse the request by Fountainhead Pub Ltd., for off-premise sales in the Class ‘D’ Neighbourhood Pub at 1025 Davie Street, having considered the support of residents and business operators of the community as determined by neighbourhood notification.

B. THAT Council advise the Liquor Control and Licensing Branch it does not support the request by Fountainhead Pub Ltd., for off-premise sales in the Class ‘D’ Neighbourhood Pub at 1025 Davie Street, having considered the opinion of residents and business operators of the community as determined by neighbourhood notification.

GENERAL MANAGER’S COMMENTS

The General Manager of Community Services submits the choice of A or B for CONSIDERATION.

COUNCIL POLICY

On May 18, 2000, Council adopted the West End Licensing Policy, which included:

THAT allowances be made for up to seven additional Class ‘D’ Neighbourhood Pubs in two phases. Phase one: 2000 - mid 2002 (four pubs). Phase two: Mid 2002 - 2004 (three pubs), generally distributed and phased as follows:

Davie Village

· 1000 block Davie Street - Phase one: One neighbourhood pub with up to 65 seats and 20 patio seats.

· 1100 block Davie Street - Phase one: One neighbourhood pub with up to 65 seats and 20 patio seats. Phase two: One neighbourhood pub with up to 40 seats and 10 patio seats.

· 1200 block Davie Street - Phase One: One neighbourhood pub with up to 40 seats and 10 patio seats. Phase two: One neighbourhood pub with up to 40 seats and 10 patio seats;

and in addition, the opportunity for one Restaurant-Class 2 in the Davie Street Village (1000-1200 block) with up to 100 seats and 20 patio seats.

PURPOSE

Fountainhead Pub Ltd., is requesting a Council resolution endorsing its application for off-premise sales in the Class ‘D’ Neighbourhood Pub at 1025 Davie Street.

BACKGROUND

On September 16, 1999 and with an amendment on October 5, 1999 the Vancouver Liquor Licensing Commission endorsed the application for a Class ‘D’ Neighbourhood Pub at 1025 Davie Street, having considered the support of residents and business operators of the community as expressed through the results of a referendum. However, Council did not endorse the request for off-premise sales.

In a letter dated November 22, 1999, to Hick and Associates Consulting Ltd., who act on behalf of Fountainhead Pub Ltd., the Liquor Control and Licensing Branch gave pre-clearance approval to proceed with the application for a Class ‘D’ Neighbourhood Pub, with a condition that off-premise sales of packaged liquor not be permitted.

The applicant is anxious to have this issue considered again by Council. On June 5, 2000, the Liquor Control and Licensing Branch announced that no further off-premise sales will be granted. However, this application was received prior to the revision date and, therefore, the request is being brought to Council for consideration.

The Fountainhead Pub has been open and operating without incident since March 15, 2000. The Pub appears to be well accepted by the businesses and residents within the community.
DISCUSSION

The co-owners of the Fountainhead Pub are involved separately in two other pub applications in the area (1240 Thurlow Street and 1167 Davie Street). Neither of these two operations had a liquor license by the cutoff date, and it is unlikely that an application for off-premise sales endorsement would be considered.

Although this is not a preferable location, given that a private wine store (Marquis Wine Cellar), is across the street at 1034 Davie, and there is a provincial liquor store at 1155 Bute Street, it is recognized that there may be a need for a retail liquor outlet in the Davie Village. The closest provincial government liquor store is located at 1155 Bute Street.

RESULTS OF NOTIFICATION

A neighbourhood notification was conducted and 1,065 notices were delivered in the notification area (refer to Appendix A). The results of the notification showed that 2 were in favour and no negative responses were received prior to finalizing the report.

COMMENTS

The Police Department opposes the application.

The Planning Department has no concerns with this application. However, if endorsed, the applicant will need to obtain a Minor Amendment to the Development Permit.

The Vancouver/Richmond Health Board has no objection.

The Social Planning Department has no comments on this application.

The Housing Centre has no comments on this application.

CONCLUSION

Staff puts this application forward for consideration by Council. The Police Department object to providing additional retail off-premise sale outlets in this area. However, staff note that with the recent change in the Liquor Control and Licensing Branch’s policy prohibiting any further off-premise sales endorsements, there may be a need to have an additional retail outlet in this community.
