Local Improvements Flat Rates and Projects to be Cancelled

RECOMMENDATION

COUNCIL POLICY

Policies governing the Local Improvement process are set out in the Vancouver Charter and Local Improvements Procedure By-law.

Clause 51B of the Local Improvement Procedure By-law provides that, by resolution, Council may establish a flat rate per foot frontage with respect to any two or more projects of a like nature, based on the average cost per foot frontage of such projects, as established by Council.

PURPOSE

This report requests Council approval of flat rates to be charged to property owners for their share of local improvement projects certified complete in 2004. These rates will be used for local improvement billings to be sent out in March 2005.

DISCUSSION

For the Local Improvement projects certified complete in 2004, flat rates have been derived from contract costs and the cost of work done by City forces, together with other general expenses and an allowance for interest over the construction period.

These flat rates have been developed in accordance with the provisions of the Vancouver Charter and the Local Improvement Procedure By-law; they do not exceed by more than the allowable 10% the estimated rates approved by Council in the respective Second Step reports for each Court of Revision.

The applicable rates are shown on the "List of Projects Certified Complete in 2004" on file in the City Clerks Office.

Projects to be cancelled

Projects that were approved at a previous Court of Revision should be cancelled for the following reasons explained below.

1. Court #593, Item #35, for sidewalk reconstruction on Dunsmuir Street, North Side, from Seymour Street to the lane east of Seymour Street.

2. Court #602, Item #67, for sidewalk reconstruction on Davie Street, South Side, from the lane east of Burrard Street to Hornby Street except 12 feet fronting Lot C

3. Court #605, Item #35, for sidewalk reconstruction on Cambie Street, Both Sides, from 16th Avenue to 19th Avenue and 18th Avenue, South Side, from Cambie Street to the lane east of Cambie Street except 8 feet fronting Lot 5 & 6 Block 520A Plan 2412 (3353 Cambie) and 33 feet fronting Lot 7 Block 520A Plan 2412 and except Cambie Street, East Side, from 16th Avenue to 17th Avenue and 7 feet fronting Lot 3 Block 521 (3338 Cambie) and 1.5 feet fronting Lot 5 Block 521 (3348 Cambie) and Lot C (3378 Cambie) and Lot B (3396 Cambie) and except 24 feet fronting Lots 1-4 Block 541 (3404 Cambie)

4. Court #610, Item #26 for speed humps on the lane east of Laburnum Street from 47th Avenue to the lane north of 49th Avenue.

5. Court #614, Item #30, for a new sidewalk on 1st Avenue, South Side, from Scotia Street to 99 feet east of Scotia Street excluding 20 feet fronting Lot 1 & 2 Block 4 DL 200A Plan 197.

6. Court #614, Item #31, for sidewalk reconstruction on Burrard Street, West Side, from Melville Street to Georgia Street.

7. Court #615, Item #17, for a new sidewalk on Manitoba Street, East Side, from 19th Avenue to 20th Avenue.
